These Terms form an agreement between you and VSpark AI LLC (“VSpark,” “we,” “us,” or “our”) for Uncensored AI Video Generator at uncensoredaivideo.com and related product features (the “Service”). By accessing or using the Service on or after the effective date, you agree to these Terms and the linked Privacy Notice, Content Guidelines, Trust and Safety policy, and Refund Policy. If you do not agree, do not use the Service.

Eligibility and accounts

You must be at least 18 years old, have reached the age of legal majority where you live, and have legal capacity to enter this agreement. The Service is not directed to minors. An 18+ confirmation is a product control and is not represented as legal age verification.

You must provide accurate account information, protect your sign-in method, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise. You may not share or use an account to evade access, safety, or usage controls.

The Service

The Service can accept text prompts and authorized reference media, show available models and settings, display applicable Credits, and track private video and image results in the signed-in Workspace. Models, inputs, settings, processing times, Providers, and availability can change. A displayed option is not a promise that every request will complete or produce a particular result.

Generative AI can produce inaccurate, unexpected, similar, or inappropriate material. You must review each Output before relying on, publishing, or distributing it. We do not promise that an Output will be unique, accurate, suitable for a particular purpose, or free of third-party claims.

Adult-oriented and pornographic content

You may not use the Service to create, upload, request, publish, distribute, or facilitate adult-oriented content or pornographic material. This restriction applies in addition to the strict minor-safety and consent rules below.

“Uncensored” is a product and creative-positioning term. It is not a promise that a request will run, permission to ignore these Terms, or a service for bypassing safety review, Provider controls, or applicable law.

Minors are strictly prohibited

You may never create, upload, request, possess through, or share using the Service:

  • child sexual abuse material, grooming content, or any sexual or sexualized depiction of a person under 18;
  • sexual or sexualized content involving a person whose adulthood cannot be determined with reasonable confidence;
  • an adult intentionally presented, styled, described, or role-played as a minor in a sexual context; or
  • fictional, synthetic, altered, age-regressed, or animated sexual content depicting or presenting a minor.

These rules apply regardless of claimed consent, artistic purpose, jurisdiction, or whether a depicted person is real. We may use automated and human review to assess age and prohibited content. If the Service cannot determine adulthood with reasonable confidence, the request or content may be rejected or removed. A content-level rejection based on uncertain age is not appealable, although you may report a technical or account error through the published support channel. Do not send suspected child sexual abuse material to us; use the appropriate official reporting channel.

Users retain the rights they already hold in prompts, images, and other submitted material. Every Input requires the rights, permissions, and consents appropriate to its intended use, including consent for a person's image, likeness, voice, or personal information.

Consent to capture or privately share an image is not automatically consent to create or publish a synthetic video. Where an identifiable real person is involved, authorization must cover the source, transformation, and intended distribution. Public availability of an image does not by itself grant those rights. Public-figure face or voice cloning is outside the product boundary.

Non-consensual intimate imagery, sexual violence, deceptive impersonation, doxxing, harassment, extortion, and privacy abuse are prohibited. Consent must be informed, specific, freely given by an adult with capacity, and not obtained through coercion or deception. You must keep sufficient authorization records and provide them if reasonably required to investigate a rights or safety report.

Inputs, Outputs, and service license

As between you and us, you keep any rights you hold in Inputs and Outputs, subject to applicable law, these Terms, Provider terms, and third-party rights. AI-generated material may not qualify for intellectual-property protection, may not be exclusive, and may be similar to material generated for others. The Service does not grant rights in third-party material contained in an Input or Output.

You grant us and our service providers a limited, worldwide license to host, copy, transmit, transform, and process Inputs and Outputs only as reasonably necessary to provide, secure, troubleshoot, moderate, and improve the operation of the Service, respond to your requests, and comply with law. This license does not authorize us to use customer Inputs or Outputs to train a general-purpose AI model. Provider-specific processing, training, and retention practices are addressed in the Privacy Notice as they are verified.

Results are private by default. If Gallery publication is offered, only an eligible Output that passes the publication review can be submitted for public display. Before publishing, you reconfirm that every depicted person is an adult, all required source and transformation consent exists, you hold the relevant copyright, privacy, publicity, and distribution rights, and public display is permitted.

Public Gallery material can be viewed, copied, linked, or shared by others and may leave the Service. By choosing to publish, you grant us a non-exclusive, worldwide, royalty-free license to host, transcode, reproduce, display, distribute, and promote that material solely to operate and present the Service and Gallery. You remain responsible for the publication decision and the accuracy of the authorization records. Removing an item stops new public display under our control after reasonable processing time, but cannot recall copies already obtained by others or records we must lawfully preserve.

Other prohibited use

You may not use the Service for illegal activity; fraud; malware; trafficking; hate-based abuse; credible threats; infringement; unauthorized commercial exploitation of another person's identity; attempts to discover or expose private information; interference with the Service; reverse engineering except where law prohibits that restriction; or circumvention of authentication, rate, safety, or Provider controls.

We may block a request, restrict or remove content, preserve narrowly scoped records, suspend or terminate access, or contact relevant authorities where reasonably necessary to enforce these Terms, protect people or the Service, investigate abuse, or comply with law. Reports and appeals follow the Reporting, Copyright, Takedown, and Appeals process.

Credits, purchases, and refunds

Credits are product usage units, not money, stored value, or a bank balance, and cannot be redeemed for cash. The Workspace shows the applicable Credit amount for your selected model and settings before submission when that information is available.

Unless mandatory law requires otherwise or an offer expressly states a different rule, purchases are final and non-refundable after purchase. We may manually review duplicate charges, billing errors, or paid Credits that were not delivered. Generation-related Credit reservations, charges, and releases may be corrected under product records; a Credit correction is not necessarily a cash refund. See the Refund Policy.

Privacy

Our Privacy Notice describes the categories of information used to operate the Service, Provider processing, retention boundaries, and how to submit access, correction, or deletion requests. Do not upload sensitive material that is unnecessary for generation.

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, permanent storage, successful generation, or any particular Output. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

Governing law and individual arbitration

Please read this section carefully. It requires most disputes to be resolved through individual arbitration and includes a class-action waiver.

Wyoming law governs these Terms, without regard to conflict-of-law rules, except that the Federal Arbitration Act (“FAA”), 9 U.S.C. §§ 1–16, governs the interpretation and enforcement of this arbitration agreement.

Before filing arbitration, either party must send a written dispute notice describing the claim and requested relief to the other party and allow 30 days for a good-faith informal resolution. Notices to us must be sent to support@uncensoredaivideo.com and our registered address shown above.

Except for an eligible individual claim brought in small-claims court or a matter that applicable law does not permit to be arbitrated, any dispute arising from or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitrator may award relief available under applicable law only to the individual claimant. Unless the arbitrator determines that an in-person hearing is necessary, any hearing will occur remotely by video or telephone.

Either party may bring an eligible individual action in small-claims court instead of arbitration, so long as it remains individual and within that court's jurisdiction. Claims may not proceed as a class, collective, consolidated, private-attorney-general, or representative action, and the arbitrator may not combine different users' claims. If a court finds a particular request for public injunctive relief or another claim non-arbitrable, that request or claim will be severed and heard in court after the arbitrable claims are resolved, to the extent permitted by law.

State and federal courts located in Wyoming have exclusive jurisdiction only over non-arbitrable matters and actions to enforce, confirm, modify, or vacate an arbitration award. Each party consents to personal jurisdiction and venue in those courts for those limited purposes. If AAA is unavailable to administer a dispute, the parties will select a substitute forum or ask a court to appoint an arbitrator as permitted by the FAA.

Narrow user indemnity

To the extent permitted by law, you will indemnify and defend VSpark AI LLC and its officers, employees, and agents from a third-party claim, damage, or reasonable cost arising directly from your knowing or intentional submission or public distribution of material without required rights or consent, your illegal use of the Service, or your material breach of these Terms. This obligation does not apply to the extent a claim results from our negligence, willful misconduct, breach of these Terms, or unlawful conduct. We will give reasonable notice and allow you to participate in the defense; you may not settle a claim in a way that admits our fault or imposes obligations on us without written consent.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, or goodwill, arising from the Service, even if advised that such loss may occur. Our aggregate liability for all claims arising from or relating to the Service will not exceed the greater of (a) the fees you paid us for the Service during the 12 months immediately before the event giving rise to the claim or (b) US $100.

These limitations do not apply to liability that cannot be limited under applicable law. Nothing in these Terms limits mandatory consumer rights, rights under applicable privacy law, or remedies that applicable law requires to remain available.

Changes, suspension, and contact

We may update the Service or these Terms to reflect product, Provider, security, or legal changes. Material changes will be identified by an updated date and any notice required by law. Continued use after revised Terms take effect constitutes acceptance where permitted by law.
